However, the Texas Court of Criminal Appeals recently changed this law, ruling that these exceptions are unconstitutional. Law enforcement officials must show probable cause and obtain a warrant in order to test a driver without their consent.
Dallas County’s new district attorney. Susan Hawk became Dallas County’s newest district attorney on January 1. Mr. Whalen discussed how this may be good news for criminal offenders, since Hawk may be able to change the tone for area prosecutions and create more programs that can reduce jail sentences.
State and federal legal processes. In a past episode, Mr. Whalen compared state and federal sentencing guidelines and described the six steps of the federal criminal prosecution process: investigation, charging, arrest and bail, trail, sentencing, and appeals.
