This is important because the 5th circuit decided a case on October 15th finding that a jury must make that finding beyond a reasonable doubt if a person is subject to a mandatory minimum sentence. James’s argument was that in light of the new case and no specific finding, then the defendant is entitled to a new sentencing hearing.
