Attorney James P. Whalen Argues Case at 5th Circuit Court of Appeals

Attorney James Whalen recently appeared at the 5th Circuit Court of Appeals in New Orleans. Click here to listen to a recording of an oral argument where the sentencing judge didn’t make a specific finding as to how much drugs the defendant was responsible for. This is important because the 5th circuit decided a case on October 15th finding that a jury must make that finding beyond a reasonable doubt if a person is subject to a mandatory minimum sentence. James’s argument was that in light of the new case and no specific finding, then the defendant is entitled to a new sentencing hearing.
